These Terms and Conditions set out the basis on which Waste Clearance Docklands provides rubbish removal and waste collection services. By booking a service, you agree to be bound by these terms. Please read them carefully before confirming your booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, company or organisation that requests or receives waste collection or related services from Waste Clearance Docklands.
Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal work carried out by Waste Clearance Docklands.
Waste means any items, rubbish, refuse, junk, debris or materials that the Customer asks Waste Clearance Docklands to collect, remove or dispose of, subject to applicable legislation and restrictions.
Contract means the agreement between the Customer and Waste Clearance Docklands for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation.
Waste Clearance Docklands provides waste collection and clearance services for domestic, commercial and other clients within its operating area. Services may include, but are not limited to, household rubbish removal, bulky waste clearance, office and commercial clearance, builders waste collection and general non-hazardous waste disposal.
The precise scope of the Services will be agreed at the time of booking, based on the description of the Waste provided by the Customer and any subsequent inspection. Waste Clearance Docklands reserves the right to refuse to collect any items that are prohibited, hazardous, unsafe to move, or not as described at the time of booking.
3.1 Bookings for waste collection services may be made by phone, email or other accepted communication channels. The Customer must provide accurate information, including the collection address, type and approximate volume or weight of Waste, access details and any relevant parking or loading restrictions.
3.2 Waste Clearance Docklands may provide an estimated price based on the information supplied by the Customer. This estimate is not binding if the volume, nature or location of the Waste differs from the description provided. The final price will be confirmed on site before work commences, taking into account the actual Waste and any additional services required.
3.3 Bookings are subject to availability. Waste Clearance Docklands will use reasonable efforts to accommodate preferred dates and times but does not guarantee specific time slots unless expressly confirmed in writing.
3.4 By confirming a booking, the Customer warrants that they are at least 18 years old and are authorised to enter into the Contract and to arrange removal of the Waste from the premises.
4.1 The Customer is responsible for ensuring safe, reasonable and lawful access to the collection point at the agreed time. This includes arranging any necessary permissions, parking, loading bays or entry codes, and ensuring the area is safe for Waste Clearance Docklands personnel.
4.2 The Customer must ensure that the Waste intended for collection is clearly separated from any items not to be removed. Waste Clearance Docklands accepts no liability for removing items that were not clearly identified as to be retained.
4.3 If access is restricted or delayed due to circumstances within the Customer's control, Waste Clearance Docklands may apply waiting time charges or a failed collection fee, or may cancel the visit and treat it as a same-day cancellation.
4.4 The Customer must not request the removal of any items that are unlawful to transport or dispose of, including certain hazardous materials, unless a specific arrangement has been agreed in advance in compliance with relevant waste regulations.
5.1 Waste Clearance Docklands operates in accordance with applicable UK waste legislation, environmental regulations and duty of care requirements. All collected Waste will be taken to authorised facilities for recycling, recovery or disposal, as appropriate.
5.2 The Customer remains responsible for the classification of their Waste and for informing Waste Clearance Docklands of any special categories of waste, including but not limited to electrical items, mattresses, construction waste, plasterboard, soil, metals or recyclable materials.
5.3 Hazardous waste, including but not limited to chemicals, solvents, oils, asbestos, clinical waste, pressurised containers, gas bottles, explosives, radioactive materials or similar items, will not be collected unless there is a specific written agreement and relevant licensing is in place. Waste Clearance Docklands may refuse to handle any item it reasonably believes to be hazardous or non-compliant with waste regulations.
5.4 Title to the Waste passes to Waste Clearance Docklands upon loading, subject to compliance with applicable laws. However, if any item is later found to be illegal to possess, transport or dispose of, the Customer shall remain liable and shall indemnify Waste Clearance Docklands for any resulting loss, cost or liability.
6.1 Unless otherwise agreed in writing, prices are based on factors including the volume, weight and nature of the Waste, the labour involved, access conditions and any disposal charges. Price lists, if provided, are indicative and may be updated from time to time.
6.2 All prices are quoted in pounds sterling and may be subject to applicable taxes. Any such taxes will be detailed on the invoice where relevant.
6.3 Payment is due on completion of the Services on the day of collection, unless an account facility or different terms have been agreed in advance. Waste Clearance Docklands accepts commonly used payment methods including card and bank transfer, subject to availability at the time of service.
6.4 For account customers or commercial contracts, invoices must be paid within the agreed credit period. If no such period is stated, invoices are payable within 14 days of the date of issue.
6.5 Waste Clearance Docklands reserves the right to charge interest on overdue amounts at the statutory rate from the due date until payment is received in full, as well as reasonable costs of collection and enforcement.
7.1 The Customer may cancel or amend a booking by contacting Waste Clearance Docklands as soon as possible. To avoid a charge, cancellations must normally be made no later than the close of business on the working day before the scheduled service, unless otherwise specified at the time of booking.
7.2 Same-day cancellations, or cancellations made after the driver has been dispatched, may incur a cancellation fee or call-out charge to cover wasted travel and administration costs.
7.3 If the Customer wishes to significantly change the nature or volume of Waste to be collected, Waste Clearance Docklands reserves the right to revise the quoted price or reschedule the service if the change cannot reasonably be accommodated within the original booking.
7.4 Waste Clearance Docklands may cancel or reschedule a service due to reasons beyond its reasonable control, including adverse weather, traffic disruption, vehicle breakdown, staff illness or safety concerns at the collection site. In such cases, the Customer will be offered an alternative service date. Waste Clearance Docklands shall not be liable for any loss arising from such cancellation or delay, save for refunding any pre-paid amounts for services not delivered.
8.1 While Waste Clearance Docklands aims to attend on the agreed date and within any indicated time window, all arrival times are estimates and are not guaranteed, unless expressly confirmed as a timed booking.
8.2 The Customer acknowledges that waste collection services can be affected by traffic conditions, access issues, previous jobs overrunning and other operational factors. Waste Clearance Docklands will use reasonable endeavours to keep the Customer informed of any significant delay.
8.3 Waste Clearance Docklands is not liable for any indirect or consequential loss, such as lost earnings, inconvenience or missed appointments, resulting from delayed arrival or rescheduling of the service.
9.1 The Customer warrants that they either own the Waste and the premises from which it is collected, or have full authority from the legal owner to arrange its removal and disposal.
9.2 The Customer shall indemnify Waste Clearance Docklands against any claims, losses, damages, fines or expenses arising from a breach of these warranties, including any claim made by a third party regarding ownership of the Waste or property.
9.3 The Customer agrees to comply with all applicable laws and regulations relating to Waste and to provide any documentation reasonably required by Waste Clearance Docklands to comply with waste duty of care obligations.
10.1 Waste Clearance Docklands will exercise reasonable care and skill when performing the Services. However, the Customer acknowledges that waste collection work may involve moving bulky or awkward items in confined spaces, and some minor scuffs or marks can occasionally occur.
10.2 Waste Clearance Docklands shall not be liable for any pre-existing damage, structural weakness, wear and tear, or defects in the property, fixtures, fittings, driveways, paths or access routes.
10.3 Waste Clearance Docklands' total liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific service giving rise to the claim, or any higher amount recoverable under its relevant insurance policy, if applicable.
10.4 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under UK law.
10.5 Waste Clearance Docklands will not be liable for loss of profit, loss of business, loss of contracts, loss of opportunity, loss of use, or any indirect or consequential loss or damage, whether foreseeable or not.
11.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with Waste Clearance Docklands as soon as possible, providing full details and any supporting information.
11.2 Waste Clearance Docklands will investigate complaints in a fair and timely manner and, where appropriate, may offer a remedy such as a partial refund, a price adjustment or a return visit to address outstanding issues, subject to the circumstances and evidence provided.
11.3 Any complaint relating to alleged damage or loss should be notified within a reasonable time of the service, and the Customer should allow Waste Clearance Docklands an opportunity to inspect the issue before any repairs or replacement are carried out by third parties.
12.1 Waste Clearance Docklands may collect and process personal data necessary to arrange and carry out the Services, including contact details, service addresses and payment information. Such data will be handled in accordance with applicable data protection laws.
12.2 Personal data will be used for purposes including customer administration, service delivery, invoicing, accounts management and legal compliance, and may be retained for a reasonable period consistent with these purposes and regulatory requirements.
12.3 Waste Clearance Docklands may share relevant information with its staff, agents, subcontractors, insurers or professional advisers where necessary to provide the Services or protect its legitimate interests, subject to appropriate confidentiality and data protection safeguards.
13.1 Waste Clearance Docklands reserves the right to use subcontractors or agents to perform all or part of the Services, provided that it remains responsible for the overall performance of the Contract.
13.2 These Terms and Conditions shall apply equally to any Services carried out by approved subcontractors on behalf of Waste Clearance Docklands.
14.1 Waste Clearance Docklands may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that particular Contract.
14.2 Any variation to these Terms and Conditions requested by the Customer will only be effective if agreed in writing by an authorised representative of Waste Clearance Docklands.
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the provision shall be deemed deleted.
15.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of waste collection and clearance services by Waste Clearance Docklands.
By requesting or confirming a booking with Waste Clearance Docklands, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
